If a worker is determined to be an employee, the business may become obligated to remedy various claims, including wages and benefits. The Department of Labor is also assessing the joint employer situation. The IC rate also does not consider costs associated with the continuous employment of the staff member and whether that staff member is replaced.

The staff member rate charged by the provider includes costs associated with the administration, recruiting and legal review. The rate also may include costs associated with the replacement of the staff member. The staff member rate charged by the provider is higher than the IC rate.

What the Staff Rate Includes

Consider a situation in which a staff member charges a rate for his/her services that is lower than the rate charged by the staff augmentation provider. The staff augmentation provider rates may cover costs associated with the administration, recruiting and legal review.
